Scope

The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders placed and contracts concluded (hereinafter referred to as “Order”).

Hofmann + Limacher Apartment Mode, alias THE APARTMENT STORE, reserves the right to change the GTC. The version of the GTC valid at the time of the order is authoritative and cannot be changed unilaterally for this order.

Offer

The offer is aimed at natural persons. It is valid as long as it is visible on our website and/or while stocks last. Prices and product ranges are subject to change at any time. The images shown and all information about the products are for illustrative purposes only and are not binding.

Price

Prices are in Swiss francs and include value added tax (VAT). For orders, the price on the website at the time of ordering is decisive.

Order

The presentation of products on the website does not constitute a legally binding offer, but rather a non-binding online catalog or a non-binding invitation to customers to order the product. THE APARTMENT STORE reserves the right to limit the delivery quantities for certain products.

An order is considered an offer to THE APARTMENT STORE to conclude a contract.

THE APARTMENT STORE is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded; in particular, products that cannot be delivered will not be forwarded. Products that are temporarily unavailable cannot be reserved.

Means of payment

All major debit and credit cards are accepted as means of payment.

Conclusion

A contract is only concluded upon successful payment in THE APARTMENT STORE's online shop. To do so, the person placing the order must agree to the use of customer data for the specified purpose and accept the terms and conditions. An order confirmation will be sent by email.

Deliver

After successful payment of the order, the goods will be prepared for shipment as quickly as possible during the store's opening hours. This is usually within 24 hours. However, the actual shipment may be delayed due to weekends or public holidays.

  • Switzerland: Flat rate of CHF 12 with Swiss Post Priority. Free shipping on orders over CHF 300 / 1-3 business days
  • Europe: Flat rate of CHF 40 with Swiss Post Priority. Free shipping on orders over CHF 500 / 3-5 business days
  • Other zones: Flat rate of CHF 70 with Fedex/UPS. Free shipping on orders over CHF 800 / 3-5 business days

The delivery times stated are approximate and cannot be guaranteed by us.

Customs clearance and import costs are to be borne by the recipient. If the shipment is refused by the recipient due to excessive import costs and is returned, a handling fee of CHF 50 will be charged. The same applies in the event of non-delivery and missed collection deadlines.

Warranty and liability

If, contrary to expectations, a purchased item proves to be defective (e.g., manufacturing defect), this must be reported to us in writing. A decision on repair or replacement will be made on a case-by-case basis. We are always interested in finding a reasonable solution for all parties involved. There is no right to warranty in the event of improper use and/or natural wear and tear. Damage that did not occur to the delivery item itself (consequential damage) is also excluded from this right.

Returns, credit notes

If the items you ordered do not fit, please contact us within seven days by email: info@theapartmentstore.ch

Returns are only possible if the items are complete, unworn, unwashed, and in perfect condition. As soon as the goods arrive at our premises, they will be checked accordingly.

Price-reduced items (sale items) are excluded from returning.

We will not cover the transport costs for the return shipment.

The credit will be issued as shop credit with no expiry date. Other forms of refund are not possible.

Severability

Should individual provisions of this contract, including these provisions, be wholly or partially invalid or should this contract contain a loophole, this shall not affect the validity of the remaining provisions or parts of such provisions. The invalid or missing provisions shall be replaced by the relevant statutory provisions.

Applicable law and place of jurisdiction

The legal relationship between THE APARTMENT STORE and its customers is governed by Swiss law. The place of jurisdiction is Zurich.

These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich.

Data

The use of personal data is governed by the privacy policy. The privacy policy is an integral and binding part of these GTC.

In it, we inform you how and why we collect, process, and use your personal data. This privacy policy is based on the European General Data Protection Regulation (GDPR), which has established itself internationally as the standard for strong, effective data protection.

The data transmitted when placing an order will be used exclusively for processing the order. The data is stored on our servers in Switzerland. We expressly reject any transfer of data to third parties.
